The present conditions of sale are concluded on the one hand by the director of Maison Déco Lumière. E-mail: contact@maison-deco-lumiere.fr and, on the other hand, by any individual or legal entity wishing to make a purchase via the https://home-decor-light.com/ website, hereinafter referred to as “the buyer”.
Object
These General Terms and Conditions of Sale apply to all orders placed via the https://home-decor-light.com/ website and to all orders received by mail or telephone, whatever other clauses may appear on the buyer's documents.
These conditions of sale shall prevail over any other general or special conditions not expressly approved by Maison Déco Lumière, which reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the buyer's order.
Product features
The products offered are those shown in the catalog published on the Maison Déco Lumière website. Exceptionally, an item may be out of stock. Each product is accompanied by a description drawn up by us.
The photographs in the catalog are as accurate as possible, but cannot guarantee perfect similarity with the product offered, particularly with regard to colors.
Rates
The prices shown in the catalog are inclusive of VAT in euros, applicable on the day of the order; any change in the rate may be reflected in the price of products or services. Maison Déco Lumière reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalog on the day of the order will be the only price applicable to the purchaser.
Delivery
On delivery, the purchaser must check that the goods received are undamaged and complete before signing the delivery note. Information concerning any anomaly must appear on the delivery slip. In addition, the complaint must be made to Maison Déco Lumière within 48 hours of receipt of the goods.
If no mention is made on the delivery note, no claim will be accepted.
Orders
The buyer, who wishes to buy a product or a service must obligatorily :
- Complete the identification form, giving all the contact details requested.
- Fill in the online order form, giving all the references of the chosen products
- Confirm the order after checking it
- Make payment in accordance with the terms and conditions
- Confirm order and payment
Confirmation of the order implies acceptance of these terms and conditions of sale, acknowledgement of full knowledge of them, and waiver of the right to invoke one's own terms and conditions of purchase or any other terms and conditions. All data supplied and the recorded confirmation shall be deemed proof of the transaction. Confirmation shall constitute signature and acceptance of the operations carried out.
Payment/Cancellation
In accordance with article L 121-20-2 of the French Consumer Code, the right of withdrawal cannot be exercised for any personalized order (Ordonnance n°2005-648 du 6 juin 2005 - art. 1 JORF 7 juin 2005 en vigueur le 1er décembre 2005).
For non-customized products, buyers, non-professional individuals, benefit from a cooling-off period of 14 days from delivery of their order to return the product to the seller for exchange or reimbursement without penalty, with the exception of return shipping costs. Terms of payment: the price is due at the time of order.
Payments will be made by credit card, using a secure system based on SSL (Secure Socket Layer) protocol, so that information transmitted is encrypted by software and cannot be read by any third party during transport over the network.
Payments are also accepted by cheque, bank transfer and credit card.
Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area.
In the event of damage in transit, a justified protest must be made to the carrier within three days of delivery. If delivery times exceed thirty days from the date of order, the sales contract may be cancelled and the purchaser reimbursed.
In application of article 122.2 of law 2012-387, a fixed indemnity of €40 will be due for collection costs in the event of late payment.
Warranty / Return
All products supplied by the seller are covered by the legal warranty stipulated in articles 1641 et seq. of the French Civil Code. In the event of non-conformity of a product sold, it may be returned to the seller, who will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made by post to the company's address within thirty days of delivery.
Liability :
The seller, in the online sales process, is only bound by an obligation of means; its liability cannot be engaged for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, break in service, or other involuntary problems. Personal data
In accordance with the French Data Protection Act of January 6, 1978, personal data relating to purchasers may be processed automatically. Maison Déco Lumière reserves the right to collect information on purchasers, including by using cookies, and, if it so wishes, to pass on the information collected to commercial partners.
Purchasers may object to the disclosure of their contact details by notifying Maison Déco Lumière. Similarly, users have the right to access and rectify any data concerning them, in accordance with the French Data Protection Act of January 6, 1978.
Protection of minors
In accordance with article L. 3342-1 of the French Public Health Code, the sale of alcohol to minors under the age of eighteen (18) is prohibited. The member undertakes to be at least 18 years of age when placing an order on the https://home-decor-light.com/ website.
Archiving / Proof:
Maison Déco Lumière will archive order forms and/or invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the French Civil Code. The computerized registers of https://home-decor-light.com/ will be considered by the parties as proof of communications, orders, payments and transactions between the parties.
Dispute resolution
These online sales conditions are governed by French law.
